Terms and Conditions for Scuba Diving Trips with Scuba Friends, LLC.

This website is owned and operated by Scuba Friends, LLC. These Terms set forth the terms and conditions under which you may use our website and services as offered by us. This website offers visitors specialized scuba diving trips. By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms.

In order to use our website and/or receive our services, you must be at least 18 years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.

When booking a trip, you agree that: (i) you are responsible for reading the full trip listing before making a commitment to buy it: (ii) you enter into a legally binding contract to purchase the trip when you select a dive trip and you complete the check-out payment process.

The prices we charge for using our services / for our products are listed on the website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur. Scuba Friends, LLC website information and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of Scuba Friends, LLC. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.

You agree to indemnify and hold Scuba Friends, LLC harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services offered on the website.

To the maximum extent permitted by applicable law, in no event shall Scuba Friends, LLC be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.

To the maximum extent permitted by applicable law, Scuba Friends, LLC assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.

We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review these page periodically. When we change the Terms in a material manner, we will notify you that material changes have been made to the Terms. Your continued use of the Website or our service after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the service.

You agree to receive from time-to-time promotional messages and materials from us, by mail, email or any other contact form you may provide us with (including your phone number for calls or text messages). If you don't want to receive such promotional materials or notices – please just notify us at any time.

These Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws of Ohio, without respect to its conflict of laws principles. Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by a court of competent jurisdiction located in Westerville, Ohio. The application of the United Nations Convention of Contracts for the International Sale of Goods is hereby expressly excluded.

Please read the following terms and conditions carefully before booking a scuba diving trip with Scuba Friends, LLC. By booking a trip with us, you agree to abide by these terms and conditions.

  1. Booking and Confirmation:

    • All bookings are subject to availability.

    • Full payment must be made before your reservation is guaranteed. You should not book airline tickets until you have received confirmation of your reservation.

  2. Cancellation and Refund Policy:

    • We understand that plans may change, and unforeseen circumstances can arise. To provide you with transparency and fairness, we have established the following cancellation policy for our travel package:

    • If you decide to cancel your reservation more than 90 days before the scheduled trip date, you are eligible for a 50% refund of the total package cost.

    • Unfortunately, we are unable to provide any refunds for cancellations made within 90 days of the scheduled trip. This policy is in place to account for the advanced preparations, bookings, and commitments made on your behalf as the travel date approaches.

  3. Travel Documentation Requirements:

    • While we do our best to provide you with accurate information and requirements for your travel, you are required to research individual requirements for your circumstance. We do not accept any responsibility in the case of you being unable to travel due to not having the necessary requirements to travel either domestically or internationally.

  4. Covid-19 Information:

    • I am aware that the nature of traveling will put me in contact with a wide variety of people. I also understand that some of these people may have medical conditions including the Coronavirus. I understand that it is my responsibility to keep myself safe during these trips in whatever manner I feel is necessary.

  5. Participant Requirements:

    • Participants must be in good health and possess a valid scuba diving certification.

    • Participants must have completed a scuba dive within the last 12 months, or have done a refresher course in order to be current with their scuba diving skills.

    • It is the participant's responsibility to disclose any medical conditions that may affect their ability to dive safely.

  6. Travel Insurance:

    • Travel insurance is highly recommended to protect the diver from not only complications that may happen during the trip, but from unseen problems with flights, or unexpected medical conditions that may arise during our trips.

  7. Privacy Policy:

    • Scuba Friends is committed to protecting the privacy and security of your personal information. We do sometimes use this information in our marketing efforts. You can find the more information in our privacy policy.

  8. Right to Change Offering:

    • Scuba Friends reserves the right to modify, alter, or adjust any aspect of the offered dive trip, including, but not limited to, dive sites, itinerary, accommodations, transportation, and associated services. Such changes may be deemed necessary due to reasons such as, but not limited to, weather conditions, safety concerns, unforeseen circumstances, or any other factor affecting the overall quality of the experience.

  9. Liability Waiver:

    • Participants are required to sign a liability waiver before participating in any scuba diving activities.

    • Scuba Friends is not liable for any loss, injury, or damage to personal property during the trip.

  10. Health and Safety:

    • Participants must adhere to safety guidelines and instructions provided by the dive instructors.

    • Scuba Friends reserves the right to deny participation to individuals who do not meet safety requirements.

  11. Excursions:

    • Participants are not required to participate in all of the excursions included on the itinerary. However, refunds will not be given if a participant decides not to attend.

  12. Code of Conduct:

    • Participants must adhere to ethical diving practices and respect marine life and the environment.

    • Participants must behave in a manner that contributes to a positive and supportive atmosphere.

    • Alcohol consumption before a dive will not be tolerated under any circumstances.

    • Scuba Friends reserves the right to expel any participant not following the code of conduct without a refund.
